The following document states the Hay Group Transforming Learning division of Hay Group, Inc. (the “Company”) Privacy Policy (the “Policy”). Hay Group Transforming Learning’s Privacy Policy demonstrates our commitment to the privacy of all personal information of our customers, employees, and others. We comply with the W3C Recommendation of the Platform for Privacy Preferences, and comply with the U.S.-EU Safe Harbor Framework, as set forth by the U.S. Department of Commerce, regarding the collection, use and retention of personal data from the European Union.
For the purpose of this Policy, the following definitions apply:
"Hay Group Transforming Learning" means the business division of Hay Group, Inc. that provides assessment and development diagnostic questionnaires and tools as part of our leadership and talent offerings.
"Personal Data" means any information relating to an identified or identifiable natural person ('data subject'); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity. Personal Data does not include information that is encoded or anonymized, or publicly available information that has not been combined with non-public personal data.
Hay Group Transforming Learning is the sole owners of any collected information. We will not sell, share, rent or disclose any Personal Data to any third party.
We only use Personal Data for the purpose of administering our business activities and providing customer service. For example, the "Contact Us" form on our web site collects one’s name, phone number, and e-mail address, so that we can contact our web site users directly and resolve any problems or issues that they may have. The "Contact Us" form also allows one to provide feedback about our web site, which will allow us to make improvements in the future.
Much of our web site involves survey administration -- either completing surveys or registering respondents to complete surveys. The information provided (name and e-mail address) is collected solely for the purpose of survey administration. This information will not be used for sales or marketing purposes.
Our web site utilizes "cookies". For more information, please see below. The main purpose of the cookies used on our web site is to navigate between various web pages. One’s username serves as a unique identifier as one moves among pages on our web site. Additionally, cookies are used as a "backup" method of saving one’s survey answers, in the event that there is a problem with one’s Internet connection.
One may find oneself asked to complete a "Demographics" survey. The information requested on this survey is used for research purposes in creating norms for our assessments. To create useful norms, we must be able to provide a complete description of the sample of people completing the questionnaires. This survey is optional -- one can choose which questions one would like to answer, if any. This information will not be revealed to anyone in a user’s organization, except in aggregate form.
CHOICE: We will not sell, share, rent or disclose any Personal Data to any third party. In the event that this changes, the Company will offer individuals the opportunity to choose (opt-out) whether their Personal Data is (a) to be disclosed to a third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. Individuals will be provided clear and conspicuous, readily available, and affordable mechanisms to exercise choice concerning their Personal Data.
TRANSFERS TO THIRD PARTIES: In the event that we use agents and third parties in the future, the Company will obtain assurances from them that they will safeguard Personal Data consistently with this Policy. Where the Company becomes aware that an agent is using or disclosing Personal Data in a manner contrary to this Policy, the Company will take reasonable steps to prevent or stop the use or disclosure.
SECURITY: The Company will take reasonable precautions to protect Personal Data in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
DATA INTEGRITY: The Company will use Personal Information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. The Company will take reasonable steps to ensure that Personal Data is relevant to its intended use, accurate, complete, and current.
ACCESS AND CORRECTION: Upon request, the Company will grant individuals reasonable access to Personal Data that it holds about them. In addition, the Company will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.
ENFORCEMENT: The Company will conduct compliance audits of its relevant privacy practices to verify adherence to this Policy. Any employee that the Company determines is in violation of this Policy will be subject to disciplinary action up to and including termination of employment.
DISPUTE RESOLUTION: Any questions or concerns regarding the use or disclosure of Personal Data should be directed to the Company’s corporate office at the address given below. The Company will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Data in accordance with the principles contained in this Policy.
For complaints that relate to the EU and that cannot be resolved between the Company and the complainant, the Company has agreed to participate in the dispute resolution procedures of the panel established by the European Data Protection authorities to resolve disputes pursuant to the U.S.-EU Privacy Safe Harbor Principles.
Adherence by the Company to the U.S.-EU Privacy Safe Harbor Principles may be limited (a) to the extent required to respond to a legal or ethical obligation; and (b) to the extent expressly permitted by an applicable law, rule or regulation.

Microsoft Internet Explorer 7 will evaluate this policy's compact policy whenever it is used with a cookie. The actions IE will take depend on what privacy level the user has selected in their browser (Low, Medium, Medium High, or High; the default is Medium. In addition, IE will examine whether the cookie's policy is considered satisfactory or unsatisfactory, whether the cookie is a session cookie or a persistent cookie, and whether the cookie is used in a first-party or third-party context. This section will attempt to evaluate this policy's compact policy against Microsoft's stated behavior for IE7.
Note: this evaluation is currently experimental and should not be considered a substitute for testing with a real Web browser.
Satisfactory policy: this compact policy is considered satisfactory according to the rules defined by Internet Explorer 7. IE7 will accept cookies accompanied by this policy under the High, Medium High, Medium, Low, and Accept All Cookies settings.
